General Terms and Conditions This web-site is intended to be a friendly, enjoyable and useful experience, but as with anything concerning any kind of transactions there are risks involved and we strongly advise you to understand all of these terms before joining. If you view a listing that you feel is violating the general terms and conditions of this web-site as stated below please let us know by contacting us. Rights To Suspend or Terminate You agree that this web-site, at its own discretion, may terminate any auction or use of the service immediately and without notice if 1. We believe that you are not abiding by the general rules of this web-site 2. You have repeatedly broken a certain condition 3. You have listed a suspicious item 4. We believe you to be a non paying bidder In most cases when we suspect foul play we will suspend your account/listing whilst we investigate further. If our investigation is conclusive then your account with us will be terminated. Your Conduct You are solely responsible for the contents of your actions through this web-site. You must ensure that your participation in the selling or buying of items does not violate any applicable laws or regulations. By this we mean that you must check that you entitled to sell or buy the relevant item and that you are not prohibited from doing so by any law or regulation. You must not transmit through the service any unlawful, harassing, libelous, abusive, threatening, harmful, vulgar, obscene or otherwise objectionable material. You must also not transmit any material that encourages conduct that could constitute a criminal offense, give rise to civil liability or otherwise violate any applicable law or regulation. Membership Eligibility Membership to this web-site is only available to those you can form a legally binding contract. This web-site does not permit minors (under 18) to register. If any member fails to signup with their correct age the account will be terminated immediately. Privacy Policy At eWasted privacy is highly important and is controlled and managed so information is kept safe. Amendments If eWasted update or change any part of the Terms and Conditions, the changes will be highlighted to all that it may concern via an e-mail and an update notification on the homepage of the website. If any user does not agree to the terms set out within the privacy polices as amended the user must close their account as use of the site would be taken as a form of acceptance. The notification will give a time period of 30 days until the new changes become effective. Fees All fees are quoted in Pound Sterling unless otherwise stated. All current fees will be available from the Site Fees page. eWasted reserves the right to change the site fees without notice. However, all current fees will be apparent at the end of the listing process. Violations Violations of these Terms and Conditions or general disregard to the site and it’s members is taken very seriously at eWasted and appropriate action will take place for offenders. List of actions, which constitute as a violation: * Inappropriate content displayed on eWasted though listings messages or any other content displayed though the website. * Breach of any laws, third party rights or eWasted polices. * Failure to pay or deliver on the contracts formed between eWasted and it’s members. * Any attempts to falsify or abuse the feedback system * Transfer/sell accounts to another person without eWasted express permission. * Spam, abuse or use profanity in any methods of communications to eWasted and it’s members. * Circumventing the fee system, through outside trading of items sold though eWasted. * Posting content, which is in breach of the restricted items section, misleading, illegal, abusive or are not real. * Overload the server through a mass sending of data. * Copy, modify or reproduce any content on eWasted without express permission from eWasted. Shill bidding At no point will any member of eWasted staff or members of eWasted participate in bidding on an auction with the intention to either increase final fee or increase activity. This is very important to eWasted as we want a trust between eWasted and it’s members and so every member can receive the true market value for their products. Spam eWasted will never send any form of spam. If any form of spam is received please contact eWasted with details and we will do our best to resolve the situation. Members will also be terminated if they have been found to send spam or sell information, which is used to send spam. Copyright It is prohibited to copy, modify or reproduce any content on eWasted without express permission from eWasted. This includes but is not limited to pictures, publications, images, Terms and Conditions, Privacy Policy, or any other content within the site. Users of eWasted also give expressed permission to eWasted to publish any content (copyrights & trademarks) uploaded though listings royalty-free. Restricted Items Some items cannot and must not be listed on eWasted. If you are unsure of whether the listing is allowed please contact us. Users must not: * Add catalogs to listings * Include abusive language * List anything which is not an item or a service * Promote giveaways, competitions or surveys unless expressed permission has been given by eWasted * Ask buyers to pay using none approved means * List multiple listings in one, or attempt to circumvent the fee structure by any other means * Over charge for shipping costs * Include outside links or text promoting anything other than the item or service for sale Other restricted items: * Adult items * Alcohol * Animals * Artifacts * Counterfeit items * Drugs * Food * Fireworks * Illegal items * Lock-picking devices * Stolen items * Tickets or vouchers * Used cosmetics * Weapons, firearms or Knives * Weeds Any listings which breach the restricted items will undergo investigation and may have there account/listing suspended or removed. Investigation Any complaint about eWasted or any of eWasted members received will be taken very seriously. Investigations will take place if any of the following concerns are raised: * Outside deals, bid retraction or cancellation * Feedback manipulation * Failure to pay eWasted or it’s members * Shill bidding * Circumventing fees * Illegal, misrepresented listings * Use of profanity in communications * False registration details * Under the age of 18 * Disruption of the eWasted site Any breaches may result in the suspension or deletion of the users account. If any illegal actions result in the use of the website law enforcement officers may be called and legal action may be taken. No Agency No agency, joint venture, partnership or franchiser-franchisee relationship is created by this Agreement. Compensation Compensation will be given to eWasted if any breach of the Terms and Conditions occur. Including fees, loss of profit or reasonable legal fees. Limited Liability This site acts as the window for sellers to conduct auctions and for bidders to bid on sellers' auctions. We are not involved in the actual transaction between buyers and sellers. As a result, we have no control over the quality, safety or legality of the items listed the truth or accuracy of the listings, the ability of sellers to sell items or the ability of buyers to buy items. We cannot and do not control whether or not sellers will complete the sale of items they offer or buyers will complete the purchases of items they have bid on. In addition, note that there are risks of dealing with foreign nationals, underage persons or people acting under false pretense. This Web-site shall not be responsible for any items sold by Auction, for any damage to items during transit or during the inspection period, nor for misrepresentations and/or breaches of contract by either buyer and/or seller. This web-site shall not be responsible for the cost of procurement of substitute goods or any losses resulting form any goods purchased or obtained. This web-site assumes no liability for the content of the listings. However if you fall victim of a fraudulent transaction we will assist you as much as we can. eWasted are not liable for the ability or inability of users to use the site or the services and tools provided on the site. If any money, goodwill or reputation is lost due to the inability to use the site or it’s services and tools eWasted are not liable to compensate. If eWasted is found liable for anything the amount will not exceed either 1 years fees or £100 pounds Sterling depending on which is higher. If any statements within these Terms and Conditions prove to be unenforceable by law then the remaining content will still be enforceable. Access Access to the website cannot be guaranteed at all time, as unforeseen circumstances may arise out of our control. This could be because of maintenance work, server problems. However, all efforts will be made to stay online at all times. eWasted are not responsible for any consequences of this inability of access.
